DOTS Disability was engaged by Bournemouth Borough Council (BBC) to consult
with disabled people to review a draft ‘Protocol for Working with Adults at Risk who
do not want to engage with services’.
Five people took part in the consultation, including people with mental health support needs, learning disabilities, physical and sensory impairments.
The Protocol is being introduced after a recent serious case review following the
death of an adult female. In this instance the individual concerned had ‘capacity’ and
declined services through choice. The serious case review highlighted the difficult
balance that has to be struck between respecting individuals ‘rights’ on the one
hand, and the local authority’s ‘Duty of Care’ on the other.
The new Protocol addresses this grey area and provides guidance for social care managers and practitioners to support good practice in this area.
